Verdict

For every commercial vehicle claim verify Fitness Certificate validity on the date of loss. Record its number and expiry. If expired, record the fact in the compliance remarks; standard view is that an expired fitness is a Breach-of-Statutory-Warranty — insurers often take a strict stance under policy condition "Limitations as to Use" and the MV Act. The Pay-and-Recover direction (per Supreme Court cases on TP) applies to third-party, not OD. Flag — do not conceal.
